1. General / Overview
Welcome to our website. If you continue to browse and use Lady Luck Electronics you are agreeing to comply with and be bound by the following Terms and Conditions of use, which together with our Privacy Policy govern www.ladyluckelectronics.com ("Lady Luck Electronics") relationship with you in relation to this website. You are also agreeing to the manner in which Lady Luck Electronics and its “BidBuddy” operate as described on the website www.ladyluckelectronics.com. Variations or alterations in the following Terms and Conditions shall only be binding upon placing in writing on the Lady Luck Electronics site. Access to this website and the use of information on it is subject to these Terms & Conditions of Use. You should carefully read these Terms & Conditions of Use. By proceeding further, you will be deemed to have accepted them.
2. Definitions
In these Terms & Conditions of Use, the following terms shall have the meanings indicated:-
“Company", "we", "our", and "us" means Lady Luck Electronics. The term "Lady Luck Electronics" or "us" or "we" refers to the owner of the website;
"Customers" and “Users” means individuals or entities who use this website or the services of the Company or who undertake any other business with the Company;
“Privacy Policy" means our statement of practice as regards to the privacy and security of your information when accessing and/or using this website and any of the features hereon;
“Service(s)" means the services to be provided by Lady Luck Electronics;
“Terms & Conditions of Use" and "Agreement" means the terms and conditions of Company as referred to and/or contained herein;
“You" means any and all persons accessing or using this website and/or availing of any information and/or services available on or via this website.

*Promotions run by Lady Luck Electronics are only valid if they are announced on Lady Luck Electronics website or in its email newsletter. Promotions may be valid for a limited time only, and details of any such timing will be announced on the website or in a newsletter. Once the advertised ending time of the promotion has been reached, or the relevant auction or auctions have ended, the promotion is expired.
4. Eligibility to Participate / Registration with “My Lady Luck Electronics” / Disqualification
By placing an order to purchase bids through the Lady Luck Electronics website the user warrants that they are at least 18 years old, and that they are legally capable of entering into binding contracts.
Registration with "Lady Luck Electronics" is required for use. Each user may register only once under their postal address (only the actual residence, no post office boxes are allowed, etc.). Throughout the registration process, the user must select a user name. The user name may not offend general decency or infringe upon the rights of third parties. The associated account password is meant for use if the original registrant and is to be undiscloed to any other user. User accounts formed during registration are non-transferable to any other user. Any misuse of the user account shall unavoidably result in the ineligibility of the user and the report of a crime. In general, the user shall be responsible for all activities that are carried out using the user account alone with the associated password.
At Lady Luck Electronics sole discretion, Lady Luck Electronics is free at any time to temporarily or permanently prohibit the user or close their account at any time. Users will be ineligible when in the rational opinion of Lady Luck Electronics a user has violated statutory provisions or the rights of third parties. A ineligibility can also happen if Lady Luck Electronics has another justified interest in such for the safety of other users or to prevent manipulation or use of Lady Luck Electronics. In particular (but not limited to) if bids are not paid, unauthorized bidding software is used, or several user accounts are set up by the same user. Furthermore, Lady Luck Electronics reserves the right in its total discretion to restrict the number of auctions in which a user may participate or may win. In breaching these Terms, Lady Luck Electronics reserves the right to withhold deliveries or refunds for bids.
Lady Luck Electronics products and services are offered exclusively in the United States and only to private users. We do not offer our services to commercial resellers. Lady Luck Electronics reserves the right to exclude all resellers from participating in the auctions and to disable their accounts at any time.
Employees and relatives of employees of Lady Luck Electronics are not eligible to participate in Lady Luck Electronics auctions under any circumstances.
5. Bid Purchasing, Payment and Free Bids
Bidding rights, so-called "bids", have to be purchased by users prior to bidding. Only registered users can agree to the convenient online bids, which can be purchased in "BidPacks" at the current prices, which can be viewed in on the Lady Luck Electronics website. The bids must be paid for in advance. When the bids are purchased and deposited into the user’s Lady Luck Electronics account, an agreement for the purchase of the bids materializes. The invoice amount for this is due instantly.
Payment can be made by credit/debit card or via payment agents through PayPal.
Should the user cancel a payment, a return payment fee will be charged to the user. Only the user shall be accountable for these fees. Lady Luck Electronics reserves the right to disable the user account until payment in full of the invoice amount, including any fees due for the returned payment. Lady Luck Electronics also reserves the right to hold back all deliveries until all payments are up to date.
Several bids (e.g. "free bids") have a time limit. When the expire time has been reached, the bids expire and can no longer be used. There will be no refund for expired bids. Won Bids that are won in an auctions do not expire. Free Bids are only valid for the time stated in a promotion. Upon expiration, they become void and are no longer valid for use. Bids that have been placed on auctions can no longer be refunded and has been deducted from the user’s account. Refunds will not be issued for Bids placed in an auction, expired Bids, Won Bids and Free Bids. For further information on refunds please see our Refund Policy.
We give back to our customers. Lady Luck Electronics allows users to apply their bids that were placed on auctions that the user did not win, towards the final ending price of auctions that the user did win. This allows our users to benefit from their lost bids. Depending on the amount of bids placed on lost auctions, users can use their bids to pay part of the final ending price, or pay for the whole final ending price. The user must pay for their won auction. Within 24 hours, Lady Luck Electronics will verify the number of placed bids on lost auctions, and will refund back to the user, the amount of the bids to pay for or towards the currently won auction. Credit for bids will not include bids placed on the currently won auction or free bids, nor will the same bids be credited on future auctions. Once bids are credited and refunded to the customer, those bids will be deleted from the user's account and cannot be used again.
6. Bidding/ BidBuddy
Once a bid is submitted it is no longer valid and is deducted from the user’s account accordingly. The BidBuddy helps bidders place bids in auctions even if they are not online. Only registered users can submit bids routinely with one or more BidBuddys. The BidBuddy automatically submits bids based on the conditions set in advance by the user. The user can find out more information regarding the BidBuddy in our" FAQ" section on the Lady Luck Electronics website. All users are strictly forbidden from using bidding software not approved by Lady Luck Electronics, and doing so will result in immediate closure of the user's account.
7. Auction Functionality
With each bid submitted online the price of the item that the user is bidding on increases by $0.01, and in the case of specially marked auctions, by other amounts as well. A bid submitted by the user constitutes an offer from that user to Lady Luck Electronics to enter a binding contract to purchase the item should that user win the auction. A contract to buy the item does not materialize until the auction is ended and the last bidder has submitted the highest bid (auction price) as the last bidder.
Each new bid restarts a new "remaining time" for the auction. The outstanding time for each of the auctions is shown on the screen (up to 20 seconds). When two BidBuddys are bidding against each other, the increase in seconds can vary. The auction ends when no more bids are submitted within the remaining time stated and the clock reaches zero. The very last user to bid wins the auction. All other bids on the item ends and will not be refunded, other than as stated in section 5, "We give back". The last bidder is determined based on the records in the Lady Luck Electronics database and Lady Luck Electronics decision of who is the last bidder shall be final.
In the event where a clear winner cannot be determined, the auction will be voided, and there will be no winner. In this case, Lady Luck Electronics reserves the right to deem the product not won and Lady Luck Electronics reserves the right to relist the product. See our Refund Policy regarding this information.
8. Acceptance of the Win / Payment
After an auction has ended, the last bidder (“winner”) will receive an email to announce the won auction. The winner should go to the Lady Luck Electronics website and sign into their account. The winner should then go to “Won Auctions” or follow the link provided in the email. Here, information such as total price (including shipping costs) and the payment option will be displayed. The user must actively pay the total price (end price plus shipping costs) for the win by clicking the PayPal link on that page or elsewhere on the website. Once the winner has clicked on the PayPal link, the win is accepted. If a won auction has not been paid for within 14 days of the auction end date, Lady Luck Electronics reserves the right to cancel the contract and the winners right to pay for and receive delivery of an item will be permanently revoked. In this instance, the bids placed in that auction are non-refundable. The user must pay the total price of the won auction. After paying the total price, the winner will receive a confirmation e-mail. For using lost bids to pay for the user's won auction, see section 5 "We give back" or below.
Customers will receive an email within 24 hours of paying for their won auction which will contain the number of bids they have placed on prior dated lost auctions. These bids/credits will be applied towards the final ending price of the customer's won auction. Lady Luck Electronics will refund to the customer, the amount of these bids/credits. Customer will not be credited for bids placed on the won auction. Bids placed on the won auction are not valid on future lost or won auctions. Only bids placed on lost auctions are valid. Free bids are not refunded/credited.
Customers will receive an email within 24 hours of paying for their won auction which will contain the number of bids they have placed on prior dated lost auctions. These bids/credits will be applied towards the final ending price of the customer's won auction. Lady Luck Electronics will refund to the customer, the amount of these bids/credits. Customer will not be credited for bids placed on the won auction. Bids placed on the won auction are not valid on future lost or won auctions. Only bids placed on lost auctions are valid. Free bids are not refunded/credited.
The item will not be shipped to the user until the total price of the won auction has been paid to Lady Luck Electronics. A second condition for delivery is that all bids purchased and used by the user have been properly paid for. Should bids that have already been purchased and used ,but it is found that they have not been paid for, payments received shall be viewed as payment toward those bids not properly paid for. We reserve the right to hold the item won at the auction until all bids and the total price have been paid for in full. Lady Luck Electronics reserves the right to additionally charge the winner reasonable storage charges for items not paid for.
Lady Luck Electronics will send a receipt containing the paid auction price, and shipping costs. A receipt containing the auction price, shipping costs, and a tracking number will be sent to the user by Lady Luck Electronics once the item has been shipped.
9. Delivery
1. We delivery to North America only.
Estimated delivery time for an order to North America is 7 - 21 business days.
Unless otherwise stated, delivery will be made directly from our warehouse or from our suppliers to the user's address. Deliveries are made solely within the 50 states of the United States (explicitly excluding the U.S. sovereign territories of Guam, Puerto Rico, and the U.S. Virgin Islands). Some restrictions or higher shipping costs may apply if the delivery address is in Hawaii or Alaska. Please check with us prior to placing bids. Delivery times vary and any delivery time indicated is provided only as a guide and is not guaranteed. Lady Luck Electronics shall be entitled to involve third parties to satisfy its contractual obligations without being required to notify the buyer. Obvious damage to the item from transport or packaging damaged during transport is to be reported to Lady Luck Electronics immediately upon delivery.
Sometimes Lady Luck Electronics will have auctions won and that product will be out of stock for reasons beyond our control. Lady Luck Electronics reserves the right to delay shipment of the product until we are able to restock the product. Should Lady Luck Electronics not be able to deliver the item won, Lady Luck Electronics shall be entitled to substitute the item with a comparable replacement product with the same or better features, or we will provide a refund. The user has the right to choose which is suitable.
10. Returns and Cancellations
Lady Luck Electronics grants our winners the right to cancel their won item. This right is unconditional and begins at the moment the contract is fulfilled. If a user cancels the contract to which the cancellation provisions apply they are entitled to a refund of the auction end price they have paid in relation to the contract even if the goods are not defective in any way. These cancellation rights end fourteen business days after the day on which a winner received the goods.
Audio or video recordings or computer software that the customer has unsealed are not eligible for return or refund.
If a user wishes to cancel the contract, they must first inform Lady Luck Electronics in writing by letter or email, that they want to cancel within the time period noted above. Cancellations by phone are not accepted.

In order to complete a valid cancellation or return, a user must return the received product(s) in good condition, the same as would be expected at a retail store. Costs of shipping for returns will be paid by the user, unless the goods are defective. If the user is unable to return the product received or is only able to return it in part or only in a downgraded condition, the user will have to pay compensation to us, the amount refundable will be reduced accordingly.
Should Lady Luck Electronics incur additional costs for insufficient shipping costs on the return or for courier shipments and other irregular shipping methods that are over and above the paid shipping costs, these costs will be deducted from any payment paid by the customer. Sets/boxes can only be returned complete.

The operator of third party sites linked to and from this site is solely responsible for their own contents. 12. System Outage / Temporarily Halted Auctions
If no bids can be submitted for auctions, then a system outage has occurred due to an unforeseeable disruption in a system. If this happens, auctions will be temporarily halted and the remaining times for the auctions, the current bidding price and the current highest bidder will be saved. After resolving the disruption, the auctions will be continued. Temporarily halted auctions will be clearly marked. Bidders who are bidding on temporarily halted auctions shall have no right to a refund for bids used or other costs incurred.
Please be aware the it is not possible to develop and operate computer programs (software) and data processing systems (hardware) completely without errors, or to rule out any unpredictable events in connection with the internet. Lady Luck Electronics, provides no guarantee for the constant and uninterrupted availability of its website and technical systems. In addition, Lady Luck Electronics shall not be liable for any damage whatsoever incurred by auction users or third parties from using any of Lady Luck Electronics services. In particular, Lady Luck Electronics shall not be liable for damage that occurs due to bids not being received by Lady Luck Electronics from the users or not being received promptly or not being considered, as a consequence of technical dificulties.
13. Chargeback Procedure
Lady Luck Electronics, in good-faith, makes every effort to bring disputes that may arise to a fair and just conclusion. If customer does not make an attempt to resolve a dispute before initiating a chargeback procedure, their account will be deactivated immediately. 14. Trademarks
Lady Luck Electronics logos are trademarks of Lady Luck Electronics. All rights reserved. Any other trademarks appearing on Lady Luck Electronics are the property of their respective owners.
15. Service and Products Purchased
All requests for warranty or technical service and support should be made directly to the manufacturer in accordance with their terms and conditions.
16. Applicable Law / Severability Clause
This Terms and Conditions Agreement and your use of the website shall be governed by the laws of the United States of America and the State of Alabama without regard to its conflicts of laws principles. Any legal action or proceeding related to this website shall be brought exclusively in a federal or state court of competent jurisdiction sitting in Alabama.

18. Offsetting / Withholding Payment / Retention of Title
The user shall only have the right to offset if the user's counterclaims are not disputed by Lady Luck Electronics.
The user is not entitled by reason of any supposed minor defect to withhold more than a proportionate amount of the sum due.
19. Guarantee
The item descriptions provided according to the best of Lady Luck Electronics knowledge and belief. Images of products can differ from the original.
Should subsequent correction be undertaken by way of delivery of a replacement, the user shall be obligated to return to Lady Luck Electronics the item already delivered within 30 days at Lady Luck Electronics expense.
Lady Luck Electronics does not and cannot guarantee that a customer will win an auction. Lady Luck Electronics can only guarantee the delivery of bids purchased to the customer's account.
20. General
The contract between Lady Luck Electronics and users is binding on the parties and on their own successors and assigns. The user may not move, allocate, charge or otherwise dispose of any contract formed under these General Terms and Conditions or any of their rights or obligations without Lady Luck Electronics prior written consent.
Lady Luck Electronics has the right to amend and alter these General Terms and Conditions from time to time in its absolute judgment but for reasons including but not limited to changes in market conditions affecting Lady Luck Electronics business, changes in technology, changes in payment methods, changes in relevant laws and regulatory requirements and changes in Lady Luck Electronics system’s capabilities. All users are subject to the policies and terms and conditions in power at the time that they have bid for items listed on the Lady Luck Electronics website, unless any alteration to such policies or terms and conditions is required to be made by law or governmental authority or Lady Luck Electronics notifies its users of the changes to such policies or General Terms and Conditions. Lady Luck Electronics has the right to assume that all successful winners have accepted the changes to the terms and conditions unless notified to the contrary with 7 working days by the user of the items.
Lady Luck Electronics is the owner or licensee of all intellectual property rights on the Lady Luck Electronics website and the material published on it. The works are protected by copyright laws and treaties around the world and all rights relating to the same are reserved. Users may not modify any paper or digital copies of any materials printed of or downloaded. Users must also not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text. Users must not use any part of the materials on the Lady Luck Electronics website for commercial purposes unless approved by Lady Luck Electronics.
21. Disclaimer of Warranty and Limitation of Liability regarding the Use of Lady Luck Electronics.

IN NO EVENT WILL LADY LUCK ELECTRONICS, OR ANY PERSON OR ENTITY INVOLVED IN USE OF A LADY LUCK ELECTRONICS AUCTION, BE LIABLE FOR ANY DAMAGES, INCLUDING, WITHOUT LIMITATION, DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF THE USE OF OR INABILITY TO USE LADY LUCK ELECTRONICS. USER HEREBY ACKNOWLEDGES THAT THE PROVISIONS OF THIS SECTION SHALL APPLY TO ALL CONTENT ON LADY LUCK ELECTRONICS.
IN ADDITION TO THE TERMS SET FORTH ABOVE NEITHER, LADY LUCK ELECTRONICS, NOR ITS AFFILIATES, INFORMATION PROVIDERS OR CONTENT PARTNERS SHALL BE LIABLE REGARDLESS OF THE CAUSE OR DURATION, FOR ANY ERRORS, INACCURACIES, OMISSIONS, OR OTHER DEFECTS IN, OR UNTIMELINESS OR UNAUTHENTICITY OF, THE INFORMATION CONTAINED LADY LUCK ELECTRONICS, OR FOR ANY DELAY OR INTERRUPTION IN THE TRANSMISSION THEREOF TO THE USER, OR FOR ANY CLAIMS OR LOSSES ARISING THEREFROM OR OCCASIONED THEREBY. NONE OF THE FOREGOING PARTIES SHALL BE LIABLE FOR ANY THIRD-PARTY CLAIMS OR LOSSES OF ANY NATURE, INCLUDING, BUT NOT LIMITED TO, LOST PROFITS, PUNITIVE OR CONSEQUENTIAL DAMAGES. 22. Disclaimer of Warranty and Limitation of Liability regarding Purchases from Lady Luck Electronics.
All new products are sold with the manufacturer’s limited warranty only. Lady Luck Electronics warrants solely that the products sold to user under these terms shall have the characteristics specified in Lady Luck Electronics specifications for such Products as set forth in the description of each auction and assumes no further warranties. The warranty period and service varies by manufacturer and product. The full text of any such warranty is available, free of charge, upon written request mailed to Lady Luck Electronics. Warranty is excluded for the delivery of any used Products.
EXCEPT FOR THE WARRANTIES SET FORTH ABOVE LADY LUCK ELECTRONICS MAKES NO OTHER WARRANTIES, EITHER EXPRESS OR IMPLIED, WITH RESPECT TO THE PRODUCTS, OR ANY RELATED SERVICES PERFORMED BY LADY LUCK ELECTRONICS OR ANY OF ITS AGENTS OR SUBCONTRACTORS IN CONNECTION WITH ANY ORDER, INCLUDING, WITHOUT LIMITATION, ANY WARRANTIES OF FITNESS FOR A PARTICULAR PURPOSE, WHICH OTHER WARRANTIES ARE EXPRESSLY EXCLUDED AND DISCLAIMED.
LADY LUCK ELECTRONICS SHALL NOT BE LIABLE FOR PERSONAL INJURY AND PROPERTY DAMAGE RESULTING FROM THE IMPROPER HANDLING, MODIFICATION, MISUSE OF THE PRODUCTS BY THE CUSTOMER OR ANY OTHER PERSON FOLLOWING DELIVERY BY LADY LUCK ELECTRONICS.
